We send text messages using a 10-digit long code (10DLC) registered through Twilio under the A2P (Application-to-Person) Campaign Registry. Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Desert Juggernauts, LLC website, client portal, training programs, events, and related services (the "Services"). By accessing our website, registering for a program or event, or activating a client portal account, you agree to be bound by these Terms. If you do not agree, you may not use our Services.

2. Eligibility & Minors

Our Services are available to individuals of all ages, but participants under 18 must have a parent or legal guardian register them, accept these Terms on their behalf, and provide consent for training and participation. By registering a minor, the parent or guardian represents that they have the authority to do so and accept these Terms on the minor's behalf.

3. Client Portal Accounts

When you activate a client portal account at client.desertjuggernauts.com, you may provide verbal consent (in person or by phone) to our staff to enroll you in text messaging and other communications. Verbal consent is recorded by our staff and has the same effect as written or electronic consent. You are responsible for keeping your account credentials secure and for all activity under your account.

4. Services & Registration

Desert Juggernauts offers training sessions, coaching programs, race events, and community activities. Registration for specific events or programs may be completed through external booking platforms linked from our site. Separate terms and refund policies of those platforms may apply to your registration and payment.

5. Payments & Subscriptions

Some programs are offered as monthly or annual subscriptions processed through Stripe. Subscription fees are billed automatically on a recurring basis until cancelled. You may cancel a subscription through your client portal or by contacting us. Cancellations take effect at the end of the current billing period unless otherwise stated. Refunds, if any, are governed by the specific program terms in effect at the time of purchase.

6. Assumption of Risk & Release of Liability

Participation in athletic training, running, cycling, swimming, triathlon, and related activities involves inherent risks of injury, including serious injury or death. By participating, you acknowledge that you (or, for a minor, your child) are voluntarily participating and assume all risks associated with these activities. You agree to follow all safety instructions and rules provided by our staff.

To the fullest extent permitted by Arizona law, you release Desert Juggernauts, LLC, its owners, coaches, employees, volunteers, and agents from any claims, damages, or liabilities arising out of or related to your participation, except to the extent caused by our gross negligence or willful misconduct.

7. Medical Clearance

You represent that you (or your minor child) are in good physical condition and have no medical condition that would prevent safe participation. We encourage you to consult a physician before beginning any training program. You are responsible for informing our staff of any relevant medical conditions, allergies, or injuries.

8. Conduct

You agree to act respectfully toward staff, volunteers, and other participants. We may suspend or terminate access to our Services for conduct that is unsafe, disruptive, unlawful, or otherwise harmful to our community.

9. Intellectual Property

All content on our website — including logos, text, graphics, and photographs — is owned by or licensed to Desert Juggernauts, LLC and may not be reproduced without our permission. Photographs and video taken at our events may be used by us for promotional purposes unless you notify us in writing that you do not consent.

10. Limitation of Liability

To the maximum extent permitted by Arizona law, Desert Juggernauts, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from the Services is limited to the amount you paid us in the 12 months preceding the claim.

11. Dispute Resolution & Arizona Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or our Services shall be resolved exclusively in the state or federal courts located in Mohave County, Arizona, and you consent to the personal jurisdiction of those courts.

SMS Terms & Consent

1. SMS Program Overview

Desert Juggernauts, LLC sends text (SMS) messages to clients and contacts using a 10-digit long code (10DLC) phone number provisioned through Twilio and registered with the A2P (Application-to-Person) 10DLC Campaign Registry. This section describes the messages we send, how you consent, and your rights to opt out.

2. Message Types & Purpose

We send the following categories of non-marketing, informational and account-related messages:

  • Upcoming events: notifications about races, community events, and registration deadlines.
  • Sessions: reminders and updates about scheduled training sessions and coaching appointments.
  • Appointments: confirmation, reminders, and changes to scheduled appointments.
  • Account status: messages about your client portal account, billing, and subscription status.

We do not send promotional marketing messages via SMS without separate express written consent. All SMS messages are transactional or informational in nature.

3. How You Consent to Receive Texts

You may consent to receive text messages from us through any of the following methods, each of which constitutes express written consent for purposes of the Telephone Consumer Protection Act (TCPA) and Twilio's A2P 10DLC requirements:

  • Verbal consent: provided in person or over the phone to our staff, who record your consent and mobile number in your account.
  • Client portal activation: when you activate your account at client.desertjuggernauts.com and confirm your mobile number and opt-in to text messaging.
  • Registration forms: by providing your mobile number and checking a consent box on an event or session registration form.

Consent is not a condition of purchasing any property, goods, or services. You may revoke consent at any time as described below.

4. Message Frequency

Message frequency varies depending on your level of activity and the number of sessions, events, or appointments you have scheduled. Typically, you may receive up to several messages per week. You will not receive more than one message per day unless directly related to an active appointment or account issue.

5. Message & Data Rates

Message and data rates may apply. You are responsible for any message or data charges imposed by your mobile carrier. Check with your carrier if you have questions about your plan.

6. Opting Out

You can opt out of receiving text messages at any time by any of these methods:

  • Reply STOP to any text message from us. You will receive a confirmation that you have been unsubscribed.
  • Reply UNSUBSCRIBE to any message.
  • Contact us by email or phone (see Contact below) and request removal.
  • Update your preferences in the client portal.

After opting out, you will receive no further messages except a single confirmation of your opt-out request.

8. Carriers & Delivery

Messages are delivered through Twilio and may be subject to the policies and filtering of your mobile carrier (including AT&T, T-Mobile, Verizon, and US Cellular). We are not responsible for delayed or undelivered messages caused by carrier systems or network issues.

9. A2P 10DLC Campaign Details

Our SMS program is registered with the A2P 10DLC Campaign Registry under a standard-use campaign for the purpose of delivering account, session, event, and appointment notifications. The brand and campaign have been vetted to meet carrier requirements. We comply with Twilio's Acceptable Use Policy and the CTIA Messaging Principles and Best Practices.

10. Privacy

Information we collect for SMS messaging (your mobile number and message content) is handled in accordance with our Privacy Policy. We do not sell your mobile number or message data. Message content may be stored for our records and customer service purposes.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

11. Changes to SMS Terms

We may update these SMS Terms as needed to remain compliant with Twilio, carrier, and regulatory requirements. We will post changes here with a revised "Last Updated" date. Continued receipt of messages after changes are posted constitutes acceptance of the updated terms.
